Terms of Service
These Terms of Service ("Terms") govern your access to and
use of the Local Adjuster software-as-a-service platform, including
the local-adjuster.com website, the App, Admin and
Platform panels, and any related APIs (collectively, the
"Service"). The Service is operated by Local Adjuster
("we", "us", or
"our"). By creating an account, signing in, or
otherwise using the Service, you agree to be bound by these Terms.
1. Eligibility & accounts
You must be at least 18 years old and authorized to bind the organization on whose behalf you use the Service. You're responsible for keeping your password secure and for everything that happens under your account. Let us know immediately at support@local-adjuster.com if you suspect unauthorized access.
2. Your data
You retain all rights to the client, claim, financial and other records you upload to the Service ("Customer Data"). You grant us a limited license to host, process and display Customer Data solely to provide and improve the Service. We don't sell Customer Data and we don't share it with third parties except as required to deliver the Service (e.g. infrastructure providers) or as described in our Privacy page.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any insurance or consumer-protection regulation that applies to your practice;
- Upload content that infringes someone else's intellectual property, contains malware, or that you don't have the right to share;
- Reverse-engineer, scrape, or attempt to interfere with the Service or other users' accounts;
- Use the Service to send spam or unsolicited messaging in violation of TCPA, CAN-SPAM, or similar laws.
4. Fees & billing
Paid plans renew automatically until cancelled. Fees are charged in advance and are non-refundable except where required by law. We may change our prices on at least 30 days' notice; continued use of the Service after a price change constitutes acceptance.
5. Availability & changes
We work hard to keep the Service available, but we don't guarantee uninterrupted service. We may add, remove or change features at any time; if a change is material, we'll do our best to give you reasonable notice in-app or by email.
6. Termination
You can stop using the Service at any time by writing to support@local-adjuster.com. We may suspend or terminate accounts that violate these Terms, fail to pay, or pose a security risk. After termination, we'll provide a reasonable window (at least 30 days) for you to export your data before it's permanently deleted from active systems.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We don't provide legal, financial or insurance advice — the Service is a tool that helps you organize your work; you remain solely responsible for the decisions you make using it.
8. Limitation of liability
To the maximum extent permitted by law, Local Adjuster will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenue, arising out of your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the fees you paid us in the 12 months preceding the event giving rise to the claim.
9. Indemnification
You agree to indemnify and hold Local Adjuster harmless from any claim arising out of (a) your Customer Data, (b) your violation of these Terms, or (c) your violation of any law or third-party right.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Los Angeles County, California.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. If the changes are material we'll notify you in-app or by email; your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
